Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you,” “customer”) and Mosafeed (“Mosafeed,” “we,” “us”). By creating an account or using the service, you agree to these Terms.

If you're using Mosafeed on behalf of a company or agency, you represent that you have authority to bind that organization to these Terms.

Mosafeed is a software-as-a-service platform that helps you plan, curate, caption, and schedule Instagram content using AI. You access the service via the web app at mosafeed.com and related domains.

Features, limits, and quotas vary by plan. Your plan's limits are displayed in your account settings and in this agreement's pricing page. We reserve the right to add, remove, or change features at any time, with reasonable notice for paid customers.

• You must be at least 16 years old to use Mosafeed.
• You must provide accurate account information and keep it current.
• You are responsible for all activity on your account, including access by team members on Agency plans.
• You must keep your password secure and notify us immediately of any unauthorized access.
• One person or entity per account. Sharing a single login across a team is not permitted — use Pro/Agency seats instead.

We offer a 14-day free trial on signup. During the trial:

• You have full access to Creator-tier features, within trial quotas.
• No payment method is required to start.
• At the end of the trial, your account downgrades to our free Starter tier (read-only) unless you activate a paid plan.
• We send email reminders 3 days and 1 day before the trial ends.

Paid plans (Creator, Pro, Agency) are billed monthly in advance via Stripe. By activating a paid plan, you authorize us to charge your payment method on the same day each month until you cancel.

• Prices are in USD unless otherwise noted.
• Prices exclude applicable taxes (VAT, sales tax, etc.) — we collect these where required.
• We may change prices with at least 30 days notice; existing subscribers keep the old price for one full billing cycle.
• You can cancel anytime from the billing portal. Cancellation takes effect at the end of the current billing period — no prorated refunds.
• Failed payments are retried 3 times over 7 days. After that, your account downgrades to Starter.

We offer a no-questions-asked refund within 7 days of your first payment. Email hello@mosafeed.com — we process refunds manually to keep it human. After 7 days, or on subsequent billing cycles, all fees are non-refundable.

You retain full ownership of everything you upload to Mosafeed — photos, videos, captions, hashtags, notes. We call this your “User Content.”

You grant us a limited license to host, display, and process your User Content solely to provide the service to you. We do not claim any ownership. We do not use your User Content to train public AI models. We do not share it with advertisers.

You are solely responsible for the User Content you upload. You represent that:

• You own the rights to the content, or have permission to use it
• Your content doesn't violate laws or third-party rights
• Your content doesn't include illegal, harmful, or infringing material

We reserve the right to remove content that violates these Terms or applicable laws, or to suspend accounts that do so repeatedly.

You agree not to:

• Upload illegal, harmful, defamatory, obscene, or infringing content
• Use Mosafeed to spam, harass, or impersonate others
• Reverse-engineer, decompile, or attempt to extract source code
• Scrape, data-mine, or build derivative products using Mosafeed's backend
• Resell the service without a written agreement from us
• Use the service to violate Meta (Instagram) terms of service or similar third-party rules
• Interfere with or disrupt Mosafeed's infrastructure, security, or other users
• Create multiple accounts to circumvent trial limits or abuse prevention

Violation may result in immediate account suspension without refund.

When you connect your Instagram Business account, you authorize Mosafeed to access your account via Meta's Graph API under the permissions you grant. You remain bound by Instagram's own terms. We do not act on your behalf outside of explicit actions you initiate.

If Meta revokes access, changes API rules, or your token expires, some features may stop working until you reconnect. We are not liable for Meta-side disruptions.

We aim for 99.5% uptime but make no guarantee. We may perform maintenance with reasonable notice. The service is provided “as is,” without warranties of any kind, express or implied, including fitness for a particular purpose.

To the maximum extent permitted by law, Mosafeed's total liability to you for any claim arising from the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption).

Nothing in these Terms limits liability that cannot be legally limited — for example, gross negligence, willful misconduct, or fraud.

You agree to indemnify Mosafeed against any claims arising from: (a) your User Content, (b) your violation of these Terms, or (c) your violation of third-party rights. We'll notify you promptly of any claim and cooperate on defense.

You can cancel your account anytime from the billing portal or by emailing us. We can terminate accounts that violate these Terms with appropriate notice, except for material breaches (fraud, abuse) where we may terminate immediately.

Upon termination: your paid access ends at the current period's end, we retain your data for 30 days (for export on request), and then delete it per our Privacy Policy.

We'll notify active users by email at least 14 days before any material change. Continued use after changes take effect constitutes acceptance. If you don't accept the new Terms, you can cancel and receive a prorated refund for any unused portion of the current billing period.

These Terms are governed by the laws of Tunisia, without regard to conflict-of-law principles. Any dispute shall be brought before the competent courts of Tunis, Tunisia, except where local consumer protection law requires otherwise.

For EU/UK customers: nothing in this section prevents you from bringing a claim in your country of residence as required by local consumer protection law.

• These Terms and the Privacy Policy are the entire agreement between us.
• If any clause is found invalid, the rest remains in force.
• You can't transfer your account to someone else without our written consent.
• We may transfer this agreement as part of a merger, acquisition, or restructuring.
• Our failure to enforce any term is not a waiver of that term.
